Lisa J. Cappalli addresses CBA Real Property Section Executive Committee
Attorney Cappalli, was a guest at the March 25th meeting of the Connecticut Bar Association Real Property Section Executive Committee. Attorney Cappalli led a lively discussion about a common issue encountered by divorce as well as real estate attorneys: how a divorcing spouse can protect himself from liability to the couple's mortgage lender when that spouse transfers his interest in the family home to the other spouse in exchange for the other spouse assuming and taking full legal responsibility for the joint mortgage. With many divorcing couples now unable to sell their homes for more than the outstanding mortgage, the issue of mortgage assumption and protection is especially critical.
